Letting fees information

White and Guard are in full compliance with the Tenant Fee Act 2019. Below we outline the Permitted Payments allowed under the Act, and under what circumstances those payments may be charged. It should be noted that the Tenant Fee Act 2019 only applies to Assured Shorthold Tenancies . We are members of Propertymark, which includes their Client Money Protection Scheme. All our deposits are registered with The Deposit Protection Service. We are also members of the Property Redress Scheme Membership No: PRS006357

We believe in being completely upfront regarding our fees – so you can manage the cost effectively and don’t have to worry about any hidden charges along the way.

Permitted payments for assured shorthold tenancies

Holding Deposit
We require a payment equivalent to one weeks rent to reserve the property and allow us to commence the paperwork preparation for the tenancy. This payment will later go towards the first month´s rent but will be retained in full should the applicant fail referencing or right to rent checks, withdraw from the application or fail to enter into a tenancy agreement within 15 calendar days.

Security Deposit
We will require the equivalent of five weeks´ rent where the annual rent is less than £50,000, or six weeks´ rent where the annual rent is £50,000 or above as a security deposit and this will be registered with a government approved scheme.

Rent
Rent will be agreed in advance of the tenancy. The rent will be reviewed at the conclusion of each fixed term in accordance with the relevant clauses and provisions in the tenancy agreement.

Changes to the tenancy agreement
£50 (inclusive of VAT)
Where a tenant requests a change to the tenancy agreement (e.g. A change of sharer or permission to keep pets in the property) this fee is payable for the work involved in amending the tenancy agreement. Any changes are strictly subject to the Landlord´s consent and the Landlord is under no obligation to grant such changes.

Early Termination of Tenancy
Landlords reasonable costs which will not exceed the maximum amount of rent outstanding on the tenancy.
If the tenant wishes to leave before the end of their contracted period of tenancy, a fee is payable to compensate the landlord for any loss incurred and the costs involved in securing a replacement tenant earlier than should have been necessary. Any termination is strictly subject to the Landlord´s consent.

Utilities, Council Tax, Communication Services and TV Licence
Tenants are responsible for paying bills in accordance with the tenancy agreement which will usually include council tax, utility payments (gas, electricity, water) and communication services (broadband, TV etc).

Late Rent Default Charges
Bank of England base + 3%
In accordance with the relevant clauses within the tenancy agreement, the tenant must pay a default fee for late payment of rent (which is more than 14 days overdue). Default fees will accumulate from the first day the rent is late, but will not be levied until 14 days thereafter.

Replacement of Lost Keys, Security Device or Remote Control
Tenants are liable for the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour (Inc. VAT) for the time taken replacing lost key(s) or other security device(s).

We are a member of Client Money Protect (cmp) and their Client Money Protection Scheme as well as The Property Ombudsman. The information given below is provided to ensure you are fully informed of any fees and costs involved in renting a property through Kings Estates All fees & charges are shown inc VAT. Holding deposit (per tenancy): One week’s rent – Please Note: This will be withheld if any relevant person (including any guarantor(s)) withdraw from the tenancy, fail a Right-to-Rent check, provide materially significant false or misleading information, or fail to sign their tenancy agreement (and / or Deed of Guarantee) within 30 calendar days (or other Deadline for Agreement as mutually agreed in writing). Security Deposit: Maximum Five weeks’ rent. This covers damage or defaults on the part of the tenant during the tenancy. Unpaid Rent: Interest at 3% above the Bank of England Base Rate from Rent Due Date until paid in order to pursue non-payment of rent. Please note: This will not be levied until the rent is more than 14 days in arrears. Lost Key(s) or other Security Device(s): In the event of lost/damaged keys, the cost to cut new keys plus the Landlord/Agents time involved at £15 per hour. This is payable in advance. The same applies for any other security device or key Fob/Permit. If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord and any other persons requiring keys will be charged to the tenant. Variation of Contract or Change of sharer (Tenant’s Request): Any Variation of contract or Deed of Assignment to change/replace tenants during the tenancy can be done at a cost of £50 each time. This is payable in advance. There may be occasions where the cost may exceed £50, in these circumstances receipts/invoices can be provided to show reasonable costs. This is to cover the costs associated with taking landlord’s instructions, new tenant referencing and Right-to-Rent checks, deposit registration as well as the preparation and execution new legal documents. Early Termination (Tenant’s Request): Should the tenant wish to leave their contract early, they shall be liable to the landlord’s costs in re-letting the property as well as all rent due under the tenancy until the start date of the replacement tenancy. These costs will be no more than the maximum amount of rent outstanding on the tenancy. For Non Housing Act tenancies such as company lets the following fees apply: Company Let: £600inc This is to cover referencing the company and guarantors, completing and executing the legal paperwork.

Acceptance of any offer will be subject to contract, referencing and immigration checks. You will need to pay the Rent and Deposit that is due under a Tenancy Agreement, or where the landlord is offering the property with a deposit replacement guarantee product, and you wish to take up this option, you will need to provide proof that you have purchased such a product by providing us with a copy of the insurance certificate before a tenancy can start.

Referencing and Right to Rent Checks - You will be asked to complete an application form before referencing can be undertaken, you should also provide an original photographic Identification (e.g. Passport, National id card, visa, resident permit, driving licence) and Proof of Residence (e.g. Original utility bill, council tax bill or bank statement all of which much be less than 3 months old). The need for a guarantor may not become apparent until your referencing (including references for any joint tenants) has been completed. Where a guarantor is required an application form and photographic identification with proof of residence will be required.

Referencing will cover a check against the credit file and public records of the individual, an Anti-Money Laundering check, confirmation of employment and salary details, confirmation of previous tenancy details, right to rent checks, reporting the results of all those checks to your prospective landlord to see if your application is acceptable.

Tenant deposit - In England under the Tenant Fees Act 2019 Deposits are limited to the equivalent of 5 weeks rent for new and renewed tenancies (or 6 weeks if the annual rent is £50,000 or more). This is calculated by dividing the annual rent by 52 and multiplying by 5 (or 6 if rent is £50,000 or more) and will be required to be paid at the start of the tenancy. This is subject to referencing.

Holding deposit - In England under the Tenant Fees Act 2019 Holding Deposits are limited to the equivalent of one weeks rent. This is paid in order to reserve a property. This is calculated by multiplying the monthly rent by 12 to establish the annual rent, then dividing the annual rent by 52. The Holding Deposit will be required to be paid once your offer is accepted. You will be provided with the rules of when this is to be returned to you or retained by the agent before this payment is made.

Tenant Fees Act 2019 permits certain fees / charges to be made under the following circumstances:

Default fee for late payment of rent
Chargeable from 14 days arrears calculated on the interest at 3% above Bank of England base rate on the late payment of rent for each day that the payment is outstanding.

Loss of a key or other security device
Landlords and letting agents can charge a tenant a fee to cover the cost of replacing the lost key or security device (e.g. Fob, electronic device for garage doors / security gates).

Payment on variation, assignment or novation of a tenancy - £50.00
When a tenant has requested it, landlords and letting agents can charge to vary, assign or replace a tenancy. Fee charge £50 (including VAT).

Payment on termination of a tenancy
Landlords and letting agents can require a tenant to make a payment for an early termination (surrender) of the tenancy agreement at the tenant's request.
