Hamptons Fees and Charges in England

Permitted charges in accordance with the Tenant Fee Act 2019 for assured shorthold tenancy:
Holding Deposit - Maximum one week’s rent (may go on to form part of advance rent)
First month’s rent - In advance.
Tenancy Deposit - 5 weeks of agreed rent up to £50k rent per annum or 6 weeks of rent over £50k.
Early termination requested by the tenant - A charge not exceeding the financial loss experienced by the landlord.
Late Rent - Interest charged at 3% above Bank of England base rate, when rent is more than 14 days late.
Lost key or security device - Equivalent to cost incurred.

Non housing act tenancy fees (not affected by the Tenant Fee Act 2019)
A Non Housing Act Tenancy is formed when one of the following criteria is in place:
The annual rent exceeds £100,000.
The property is occupied by an entity (Company let) rather that an individual.
The property is not used as a main or primary home.
There is a Resident Landlord.

An initial payment is required to reserve the property. This is equivalent to one weeks rent. This will hold the property for you for a maximum period of two weeks unless agreed otherwise. Your initial payment will be allocated against your total invoice amount. This payment is non refundable if you decide not to proceed with the tenancy or fail the referencing/ right to rent check. Referencing All tenants are required to be referenced. You will be emailed a referencing form to fill out online. As part of the referencing we are checking: -your credit score and any adverse credit on your record. -Your current employment with your employer/future employer. -Your Landlord reference with your previous Landlord. - An affordability check to confirm you are able to afford the rent. As part of the referencing we are required to verify that every tenant is entitled to live in the UK under the 2014 Immigration Act. We will require to see your passport or national identity card and proof of you current address (utility bill or bank statement dated in the last 3 months). Rent Payments: Rent is always payable monthly in advance and is due the 1st of every month with the first month calculated pro-rata. Advanced rents for move in dates before the 15th of the month will be calculated on the daily amount from the move in date up until the end of the same month. Advanced rents for move in dates falling on or after the 15th of the month will be calculated on the daily amount from the move in date to the end of the same month plus the following full month’s rent amount. If a property is to be managed by the landlord then a minimum of 6 weeks advanced rent will be required. A member of staff will confirm if the property is to be managed by the landlord or Mack Residential. The minimum tenancy period is six months. Inspections are carried out every 3 months on managed properties. Deposits: 5 Weeks rent Deposit (Not Vat Chargeable) will be taken before you move in. This will be registered with dps (Deposit Protection Service). No Deposit Option: We offer tenants the option to use a deposit replacement scheme instead of paying the deposit upfront. We use a company called Reposit Ltd for this service. A non refundable fee of one weeks rent is charged to the tenant. Pease ask a member of staff for more details. 'On application of any of our properties Mack Residential may provide your details to our deposit alternative provider Reposit, who will send you communication relating to your deposit free renting options, these details will include your name and email address.'

Tenants are liable to the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour (inc. VAT) for the time taken replacing lost key(s) or other security device(s).
Variation of contract (Tenant's Request)
£50 (inc. VAT) per agreed variation. To cover the costs associated with taking landlord's instructions as well as the preparation and execution of new legal documents.
Change of sharer (Tenant's Request)
£50 (inc. VAT) per replacement tenant or any reasonable costs incurred if higher.
To cover the costs associated with taking landlord's instructions, new tenant referencing and Right-to-Rent checks, deposit registration as well as the preparation and execution of new legal documents.
Early termination (Tenant's Request)
Should the tenant wish to leave their contract early, they shall be liable to the landlord's costs in re-letting the property as well as all rent due under the tenancy until the start date of the replacement tenancy. These costs will be no more than the maximum amount of rent outstanding on the tenancy.
