Hamptons Fees and Charges in England
Permitted charges in accordance with the Tenant Fee Act 2019 for assured shorthold tenancy: Holding Deposit - Maximum one week’s rent (may go on to form part of advance rent) First month’s rent - In advance. Tenancy Deposit - 5 weeks of agreed rent up to £50k rent per annum or 6 weeks of rent over £50k. Early termination requested by the tenant - A charge not exceeding the financial loss experienced by the landlord. Permitted Payments and Tenant Protection Information
Permitted payments: For properties in England, the Tenant Fees Act 2019 means that in addition to rent, lettings agents can only charge tenants (or anyone acting on the tenant's behalf) the following permitted payments:
- Holding deposits (a maximum of 1 weeks rent);
- Deposits (a maximum deposit of 5 weeks' rent for annual rent below £50,000, or 6 weeks' rent for annual rental of £50,000 and above)
- Payments to change a tenancy agreement eg. Change of sharer (capped at £50 or, if higher, any reasonable costs)
- Payments associated with early termination of a tenancy (capped at the Landlords loss or the agents reasonably incurred costs)
- Utilities, communication services, TV licence and council tax
- Interest payments for the late payments of rent (up 3% above Bank of England's annual percentage rate
- Reasonable costs for replacement or lost keys or other security devices
- Contractual damages in the event of the tenant's default of a tenancy agreement and any other permitted payments under the Tenant Fees Act 2019.
For properties in Wales, the Renting Homes (fees etc.) (Wales) Bill, once enacted, means that in addition to rent, lettings agents can only charge tenants (or anyone acting on the tenant's behalf) the following permitted payments;
- Holding deposits (a maximum of 1 week's rent)
- Deposits
- Utilities, communication services, TV licence and council tax
- Payments for the late payment of rent
- A breach of a term in the contract
- Any other permitted payments under the Renting Homes (Fees etc.) (Wales) Bill and regulations once enacted.
Tenant Protection
In addition to publishing relevant fees, lettings agents are also required to publish details of:
- The redress scheme they are a member of; and
- The name of the approved or designated Client Money Protection scheme they are a member of (if any)
Please note that lettings agents are required by law to publish on their websites information for potential tenants about relevant fees, redress schemes and client money protection schemes (including the names of those schemes) Relevant fees must also be published on third party websites, such as Rightmove. For properties to rent in England, details of the agent's membership of any redress scheme and client money protection scheme must also be published with their fees on Rightmove. It is the agent's responsibility to ensure that all relevant information is provided to Rightmove and is up to date and accurate. If the relevant information does not appear here, the agent may have included it within the property description.

This fee is non-refundable should you decide not to progress your application/sign your tenancy agreement within 15 Calendar days (unless otherwise mutually agreed) or if you have given false/misleading information on the application form or any applicant fails a Right to Rent check. It will be returned to you in the event the landlord is unable to proceed
Deposit -5 weeks’ rent (England) -This is to cover any damages, dilapidations & defaults on the part of the tenant during the tenancy. -If a pet has been permitted the deposit will increase by an extra 1 week’s rent per pet (Wales)
During the Tenancy (payable to the Agent)
English Properties: Payment of interest for the late payment of rent 3% above Bank of England base rate.

Lost Keys or other Security Devices
Tenants are liable for the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord & any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour (Inc VAT), if appropriate, for the time taken replacing any lost keys or security devices.
Variation of Contract (At Tenant’s Request and if agreed by Landlord).
£50 (inc VAT) to cover agent’s costs in contacting landlord, taking landlord instructions & preparations of new contracts (if required) & system adjustments.
Change of Sharer (At Tenant’s Request and if agreed by Landlord)
£50 (inc VAT) per replacement tenancy or any reasonable costs incurred if higher: To cover the costs associated with amending the tenancy agreement to reflect the change.
Early release from tenancy
If authorisation is given allowing you to vacate the premises before the expiration of any tenancy agreement, you may be liable for the following:
I)Rent up to the date on which the premises are re-let or the expiration of the tenancy agreement, whichever is the sooner ii)Council tax, water rates, gas and electricity charges along with any other bills which are your responsibility under the tenancy agreement up to the date the premises are re-let, or the expiration of the tenancy agreement, whichever is the sooner iii)There will be a charge, if appropriate, for the landlord’s costs for re letting the property. Iv)These costs will be no more than the maximum amount of rent outstanding
Other permitted payments. Any other permitted payments not included above, for breaches of contract or under the relevant legislation including contractual damages.
Please note: Should you report a maintenance issue with the property and a contractor is called out and their investigations find that the fault has been caused by the tenant/s or an associate of the tenant/s, or alternatively no fault exists, any cost for call out will be the responsibility of the tenant/s. Summary of fees charged for lettings
Tenant administration fees are as set out in the Application form. For all tenancies exchanged prior to 1st June 2019 these fees will remain in place until 1st June 2020. Commitment To Rent Agreement
The Tenant will be liable to pay an amount equal to 1 weeks rent in the event that the tenancy fails to progress for due to an event occurring as set out in the Application Form which details the terms of the Commitment To Rent Agreement
Refundable Holding deposit
A Landlord may require a payment of up to 1 weeks rent, instead of the Commitment to Rent Agreement terms. Cgeal will not be party to any payment arrangements or terms associated with the payment. Tenants will deal directly with the Landlord on any payment arrangements and should not make payment to any cgeal named bank account for these monies. Tenants should ensure they are wholly satisfied that the Refundable Holding Deposit arrangements are in line with current regulations before making any payment

Tenant Permitted Payments & Information
Referencing Procedure & Holding Deposit We require reference forms to be completed by all adults who will be living at the property and a holding deposit equal to 1 weeks rent to be paid to reserve the property pending successful references.
This deposit is non refundable should the tenant decide not to go ahead and sign the tenancy agreement within 15 days (unless otherwise mutually agreed) has provided false or misleading information or fails the right to rent check.
It will be returned to the tenant if the landlord is unable to proceed.
If the tenancy goes ahead this deposit will be put towards the whole deposit of 5 weeks total as detailed below in the deposit section.

I.D All tenants must provide I.D. This can be a current passport, drivers licence and birth certificate or council tax bill, identity card.
Tenancy Agreement When successful references have been received you will be required to sign a tenancy agreement and return it to us within 5 working days.
Deposit The tenant will be required to pay a deposit which is equal to 5 weeks rent (1 week of this will have already been paid as a holding deposit as detailed in the Referencing Procedure above) This will be held with the Deposit Protection scheme. Variation, assignment or novation to the tenancy agreement at the tenants request - 50 (including vat) to cover the costs of the work involved and the preparation of new agreements.
Early release from the tenancy If requested by you and authorisation is given allowing you to vacate the premises before the expiration of the tenancy agreement you may be liable for:
